The scope and general description of the GTCs
GE FOC I Ingatlanhasznosító Korlátolt Felelősségű Társaság (registered office: 2051 Biatorbágy, Budaörsi út 4.; company registration number: 13-09-197595; hereinafter referred to as "Operator") introduces a loyalty programme (hereinafter referred to as "Premier Loyalty Programme") to meet the needs of customers at Premier Outlet Budapest (2051 Biatorbágy, Budaörsi út. 4.) by using a digital code (hereinafter referred to as the "Premier Loyalty Code") that can be used to collect points and discounts when purchasing the products and using the services at the units of Premier Outlet Budapest which are members of the Premier Loyalty Programme (hereinafter referred to as the "Participating Units").
The Premier Loyalty Programme is operated by the Operator, with the assistance of a third party, at Premier Outlet Budapest, and the access to the Premier Loyalty Programme is provided through the Premier Loyalty Code. The Premier Loyalty Programme is part of the Operator's marketing system that enables and aims to reward the regular customers participating in the Premier Loyalty Programme (hereinafter referred to as the "Regular Customers") by providing the possibility to collect points and use discounts (hereinafter referred to as the "Discounts") through the use of the Premier Loyalty Code.
This GTCs apply to the legal relationship between the Operator and Regular Customers using the Premier Loyalty Code within the framework of the Premier Loyalty Programme.
The characteristics of the Premier Loyalty Programme and the Premier Loyalty Code
The Premier Loyalty Code is a non-physical, digital score card that can be accessed and used by customers through the Coniq mobile application (hereinafter referred to as the "Application"). Regular Customers may, after downloading and registering in the Application, collect and redeem points at the Participating Units in accordance with the provisions of the GTCs in force from time to time.
The use of the Application requires a mobile device capable of running the Application and also internet access available on the mobile device capable of running the Application, which is not provided by the Operator. The use of the Application may be subject to additional technical conditions (such as requirements regarding the operating system or version number, or mobile device specification requirements), which are set and made available by the publisher of the Application and / or the application-store offering the Application.
The Premier Loyalty Programme is open to all natural persons over the age of 18. Natural persons under the age of 18 may participate in the Premier Loyalty Programme with the consent of their legal representative.
The Regular Customer may only use the Premier Loyalty Code in person. Neither the Operator nor the Participating Units shall be obliged to verify, by verification of identity or otherwise, that the user of the Premier Loyalty Code has lawfully obtained the Premier Loyalty Code to which the use relates. The Operator shall not be liable for any damages resulting from unlawful use.
The Premier Loyalty Code and claiming the Discounts
The Regular Customer participates in the Premier Loyalty Programme by using the Premier Loyalty Code to earn and use points. The Premier Loyalty Code can be used immediately upon registration in the Application.
The points are calculated on the basis of the value of the purchase of each product paid for in HUF by the Regular Customer at the Participating Units.
From the launch of the Premier Loyalty Programme, Regular Customers will receive points via the Premier Loyalty Code for the purchase of all products and services sold at the Participating Units equal to 5% of the purchase price of the given products and/or services reduced by any discount that can be redeemed during subsequent purchases for up to 10% of the full purchase price in a way that 1 point shall correspond to 1 Hungarian forint. Regular Customers may earn and redeem points at any Participating Unit at Premier Outlet Budapest, i.e., whose tenant participates in the Premier Loyalty Programme, thus, the place of earning and redeeming points does not need to be the same Participating Unit. Notwithstanding the above, Participating Units providing food and beverage services and Participating Units having pop-up leases may participate in the Premier Loyalty Programme in a way that Regular Customers may not earn or redeem points in the units operated by such Participating Units as set out above, but they may redeem special loyalty offers as indicated in the Application.
The registration period for the Premier Loyalty Code points is 13 (thirteen) months (hereinafter referred to as the "Validity Period"). After the Validity Period, any available unused Points will be cancelled. The balance of the Premier Loyalty Code is included in the Application.
The Operator warrants that the Discounts will be available during the Validity Period in accordance with the instructions of the Regular Customer and that they will be made available for such validation at all times during the opening hours of Premier Outlet Budapest during the Validity Period. The Operator shall not be liable for the service or any other conduct of the mobile service provider and the issuer of the Application. The Operator is not liable for any claims or damages (including any failed crediting and redemption of points in connection therewith) arising from the malfunction of the mobile device or the Application.
Points credited through the use of the Discounts and the Premier Loyalty Code are not redeemable for cash, and the Operator does not pay or credit interest on the Premier Loyalty Code.
The use of the Premier Loyalty Code to claim discounts
The Premier Loyalty Code may only be used for the discounted purchase of products or use of services sold at the Participating Units.
The list of the current Participating Units is available on the notice board at the Premier Outlet Budapest information desk and in the app.
In the case of an active Premier Loyalty Code, the points earned from a given purchase will be credited at the same time as the purchase at the Participating Units, in accordance with the rules of the calculation of points set out Points will be credited based on the presentation of the Premier Loyalty Code at the time of purchase. Points may not be credited at a later date after purchase.
The Discount used with the Premier Loyalty Code will not be credited in case of withdrawal from the purchase. Points calculated after cancellation and subsequent refund will be deducted from the Regular Customer’s point balance in accordance with the point calculation rules set out in this section.
A discounted purchase made using a Premier Loyalty Code is subject to the general terms and conditions of the relevant Participating Unit. The Operator is not responsible for and does not warrant for any product purchased or service used using the Premier Loyalty Code, or for any breach of contract or other wrongful conduct of the relevant Participating Unit.
The Discount may not be used in combination with any other discounts, concessions or other offers.
Duration and termination of the contract
The contract between the parties for participation in the Premier Loyalty Programme and the use of the Premier Loyalty Code is concluded for an indefinite term.
The contract may be terminated with immediate effect by the Regular Customer at any time, without giving any reason, through the Application or in writing, using one of the contact details set out in the GTCs in force from time to time. In the event of the termination of the contract, the unused points will be cancelled.
The Operator may exclude the Regular Customer from the Premier Loyalty Programme in the event of any proven or reasonably suspected abuse of the Premier Loyalty Programme, non-compliance with the GTCs, any conduct or behaviour contrary to the interests of the Operator or any breach of the Premier Outlet Budapest's policies. In case of exclusion from the Premier Loyalty Programme, the points collected with the help of the Premier Loyalty Code, will be cancelled.
The Operator may, in its sole discretion, modify, terminate, limit, suspend or change the Premier Loyalty Programme.
The Operator shall inform the Regular Customers about the modification of the GTCs by means of an announcement published within the Application. The notice shall contain a precise reference to the amended provisions of the GTCs, the date of entry into force of the amendments and the details of where the amended GTCs are fully available. The Operator reserves the right to make minor changes to the Premier Loyalty Programme and to the applicable GTCs without prior notice, provided that such changes do not materially adversely affect the rights and obligations of the Regular Customer. The current version of the GTCs is available on the Application at all times. In the event that the Regular Customer does not wish to accept the amendments to the GTCs, he/she shall be entitled to inform the Operator thereof within thirty (30) days of the effective date in accordance with the notification methods set out in the GTCs in force. After the expiry of this period, the amendments to the GTCs shall be deemed to have been accepted by the Regular Customer.
If the Operator terminates the Premier Loyalty Programme and the contract between the parties is terminated for this reason, the Operator shall inform the Regular Customers of the termination of the Premier Loyalty Programme by means of an announcement published through the Application at least thirty (30) days prior to the termination of the Premier Loyalty Programme. The date of termination of the Premier Loyalty Programme shall be the date specified in the information notice.
The Operator will handle complaints regarding the use of the Premier Loyalty Code in the following ways:

For the avoidance of any doubt, the Operator stipulates that the complaints of the Regular Customer regarding the use of the Premier Loyalty Code in connection with the purchased product or the used service at a particular Participating Unit must be addressed to the relevant Participating Unit.
The Operator informs the Regular Customers that participation in the Premier Loyalty Programme and the provision of data for this purpose is voluntary, and that a Regular Customer participating in the Premier Loyalty Programme may request information about the processing of their data and may also request the correction of their data. By requesting the Premier Loyalty Code, the Regular Customer gives their consent to the processing of the data provided during registration by the Operator and the Operator's data processors in order to ensure the provision of Premier Loyalty Programme, to improve the quality of the services provided and to introduce new services. The consent given may be withdrawn, in whole or in part, at any time.
These GTCs and the interpretation thereof shall be governed by the laws of Hungary.
If any provision of these GTCs is or becomes invalid or unlawful, such provision shall be deemed severable from these GTCs and shall not affect or impair the validity, legality or enforceability of any remaining provisions of these GTCs.
These GTCs are effective from the date of publication on the Application (or other publication on the same date) until revoked.
